FREEING TACO TUESDAY
People like tacos on Tuesdays. They just do. It’s even fun to say: “Taco Tuesday.” Taco Bell took on the trademark battle for "Taco Tuesday" and they WON! Gregory Gregory, the owner of Gregory's Restaurant & Bar, has finally stood down and abandoned his previously trademarked phrase "Taco Tuesday." 🌮
As a part of our TMTelegramfamily, you will get new business tips and tricks to help empower you and your team. For our first edition, we've included details on one of our favorites: the done list.
While the to-do list has become a staple of our daily routines, it can be a source of stress and overwhelm. If you find yourself drowning in a never-ending list of things to do, it might be time to try something new: the done list.
The done list is a refreshing alternative to the traditional to-do list. Instead of focusing on what's left to be done, you celebrate what you've already accomplished. It's a simple shift in perspective that can have a profound impact on your productivity and motivation.
Here's how it works:
Start Your Day with a Positive Mindset: Instead of waking up and immediately thinking about all the tasks you need to complete, begin your day by reflecting on what you achieved yesterday. This sets a positive tone and helps you start the day with a sense of accomplishment.
Record Your Achievements: Throughout the day, keep track of what you complete. Whether it's a small task or a significant project, write it down on your done list. This simple act of recording your achievements helps you stay motivated and focused.
Stay Flexible and Adaptive: The beauty of the done list is that it adapts to your progress. If you find that you've accomplished more than you initially planned, your list will reflect it. Conversely, if you're having a slow day, you can still acknowledge what you've done rather than fixating on what's left.
Reflect on Your Progress: At the end of the day or week, review your done list. Take a moment to appreciate how much you've accomplished and how far you've come. This reflection can boost your self-esteem and motivation for future tasks.
The done list not only helps you increase your productivity but also promotes a more positive and proactive mindset. By shifting your focus from what's ahead to what you've already achieved, you'll be better equipped to tackle your tasks with enthusiasm and confidence.

Suspensions are when your application is on hold. There are various reasons a trademark application can be suspended. However “likelihood of confusion” with prior application(s) filed and submission of foreign application are the most common reasons the USPTO may suspend an application. During a trademark suspension period, your lawyer will provide guidance on the next steps and whether it might be best to file an argument or pursue a coexistence agreement.
What are Disclaimers for Trademarks?
A disclaimer usually refers to a statement which indicates that you are not claiming exclusive rights to use the word(s) or a design element in your trademark application. A disclaimer allows for registration without creating a false impression of the registrant’s rights. A good example of this is disclaiming “café” if your services are for a café.
What is the Supplemental Registry?
If a trademark is not eligible for the Principal Registry, there is sometimes an option to register on the Supplemental Registry. In cases where the USPTO finds the trademark application is merely ornamental, merely descriptive, or primarily geographically descriptive, the USPTO may allow the application to be registered on the Supplemental Registry. However, over time, the mark may acquire distinctiveness and possibly become eligible for the Principal Registry.
What is the Date of First Use?
Two dates must be specified in a trademark application: Date of First Use Anywhere: The “anywhere” refers to use in the U.S. or elsewhere. This is the date the goods were first sold or transported, or the services were first rendered under the mark. The use must also have been bona fide and in the ordinary course of trade. Date of First Use in Commerce: This is the date when the goods were first sold or transported, or the services were first rendered under the mark in interstate or international commerce. The use of the mark must have been bona fide and in the ordinary course of trade.
What is the Renewal Timeframe for a Trademark?
The renewal timeframe for a trademark is between the 9th and 10th year anniversary of the trademark registration, and then in ten-year intervals. It is important to be aware that the USPTO also requires a registrant to provide an affidavit at the 5th and 6th years of ownership stating that the trademark is still being used in commerce. Failure to comply with the renewal timeframes or the affidavit requirements will result in the cancellation of the trademark registration.
